Breaking News! FL Senate Bill 72 Signed Into Law! (Civil Liability for Damages Relating to COVID-19)

Florida official flagAccording to Florida Realtors Vice President of Public Policy, Danielle Scoggins, moments ago Governor Ron DeSantis signed one of FR’s top legislative priorities, Senate Bill 72, into law. This bill provides protections for Florida businesses and healthcare providers from lawsuits resulting from COVID-19-related circumstances.

Some highlights of these new protections are as follows:

  • COVID-19-related lawsuits will need to rely on specifics, rather than a general statement, as the basis for any complaint.
  • Lawsuits against businesses will require a physician’s affidavit attesting that the company caused the injuries/damages to occur.
  • If a court determines that a business made a good-faith effort to substantially comply with government-issued health standards, they will be immune from liability.

The bill became law the moment it was signed and the protections will apply retroactively. For more information about the new law and its effects, please refer to the bill analysis: https://flsenate.gov/Session/Bill/2021/72
